Membership Terms & Conditions

These Membership Terms & Conditions (the "Terms") govern the purchase and use of a Flat Assist USA membership and the related roadside services provided by Flat Assist USA, LLC ("Flat Assist," "we," "us," or "our"). By completing enrollment and affirmatively accepting these Terms at checkout, the purchaser ("Member," "you," or "your") agrees to be bound by them.

Memberships are sold through the Flat Assist website and web checkout. The mobile application is used for account access, vehicle registration, and roadside service requests, and is not used to sell memberships.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to purchase a membership. You must provide accurate contact, billing, vehicle, and other information requested during enrollment or account setup.

2. Service Area

Eligible roadside services are available only within the published Flat Assist service area in Broward County, Florida. Additional counties may be added in the future. Service is available only at locations within an active published service area.

A ZIP code eligibility check is performed at checkout. Availability in a given ZIP code may change as Flat Assist expands or adjusts operations.

3. Membership Plans and Registered Vehicles

Membership benefits are tied to registered vehicles. Only vehicles properly registered to an active membership are eligible for included membership services.

Family members may add eligible vehicles beyond the two included vehicles, up to four vehicles total, at the then-current add-on price of $2.99 per month or $29.90 per year per additional vehicle.

Annual plan pricing is ten times the applicable monthly price. Plan prices and benefits are subject to the change provisions in Section 12.

4. Waiting Period

A 14-day waiting period applies from the start of a new membership and from the date any new vehicle is added to a membership. Roadside service for that membership or newly added vehicle becomes available after the applicable 14-day waiting period expires.

A Member within the waiting period may either wait for the period to expire or request service at the then-current non-included service price described in Section 7.

5. Included Roadside Services

Subject to plan eligibility, service limits, safety conditions, and these Terms, Flat Assist provides the following roadside services:

Tire change. Installation of the Member's usable spare tire when available and safe to install.

Battery jump-start. A roadside jump-start attempt for an eligible vehicle battery.

Emergency fuel delivery. Delivery of an emergency quantity of fuel, as posted at the time of the request.

EV charging. Emergency mobile charging for an eligible electric vehicle, in the amount posted at the time of the request.

Vehicle lockout. Roadside assistance to gain entry to an eligible locked vehicle.

Tire-pressure check. Roadside tire-pressure inspection and adjustment when appropriate.

The Plus plan does not include vehicle lockout or EV charging. Family and Platinum include all six service categories.

6. Services and Situations Not Included

Unless expressly added in writing to a plan, Flat Assist does not provide towing, winching, recovery, vehicle transportation, mechanical diagnosis, or mechanical repair.

A tire change requires a usable spare tire suitable for the vehicle. Flat Assist is not obligated to supply a spare tire as part of a standard tire-change service.

Batteries and replacement tires are separate retail purchases and are not included in the membership fee.

7. Annual Service-Request Limit

Each registered vehicle is limited to six included roadside service requests per membership year. After a registered vehicle reaches that limit, additional eligible roadside service may be purchased at the then-current non-included service price of $59.99 per visit.

Flat Assist may deny or suspend service where reasonably necessary for fraud, misuse, nonpayment, unsafe conditions, requests outside the service area, requests involving an ineligible or unregistered vehicle, or other material violations of these Terms.

8. Service Availability and Dispatch

Flat Assist accepts eligible service requests 24 hours a day, 7 days a week. Around-the-clock operation does not constitute a guaranteed response time or a guarantee that a technician will be immediately available in every circumstance.

Dispatch depends on location, weather, traffic, safety, technician availability, service demand, road access, vehicle condition, and other circumstances outside our reasonable control.

Platinum priority dispatch means eligible Platinum requests receive dispatch priority over otherwise comparable non-priority requests. It is not a guaranteed arrival time.

9. Member Responsibilities and Safe Service Conditions

The Member must provide accurate location and vehicle information, remain reasonably available for communications, and follow safety instructions. The Member must have lawful authority to request service for the vehicle and must not request service in a location or circumstance that is unsafe or unlawful.

Flat Assist or its technician may decline, pause, or terminate a service attempt when conditions are unsafe, the requested work is outside the technician's authorized scope, the vehicle cannot be safely serviced roadside, or the information provided by the Member is materially inaccurate.

10. Service Providers

Flat Assist performs roadside services primarily through its own employees and service vehicles. Flat Assist may use properly qualified independent service providers or subcontractors where legally permissible and consistent with applicable disclosures and agreements.

11. Membership Fees, Billing, and Automatic Renewal

Membership fees are charged in advance on a monthly or annual basis, according to the plan selected at checkout. Unless canceled, the membership automatically renews for successive periods matching the selected billing cycle, and the payment method on file may be charged automatically.

By accepting these Terms and the recurring-payment authorization at checkout, the Member authorizes Flat Assist and its payment processor to charge the selected membership fee and any other expressly authorized charges to the payment method provided.

Payment processing is performed by Helcim. Flat Assist does not store full payment-card numbers on its own servers.

Applicable taxes, if any, may be added as required by law. Separate purchases, including batteries or tires, may be subject to separate pricing and taxes.

Failed payments

If a recurring payment fails, Flat Assist may make reasonable additional attempts to collect the payment and may suspend membership benefits while the account remains unpaid.

12. Cancellation and Refunds

A monthly membership may be canceled at any time, and cancellation becomes effective at the end of the then-current paid monthly billing period. An annual membership may be canceled at any time, and service remains active through the end of the paid annual term.

There is no prorated refund for unused portions of a monthly or annual membership except where required by law. There is no cancellation fee.

Members may cancel electronically through the mobile application or by contacting customer service using the details in Section 18.

13. Changes to Plans, Benefits, Prices, and Terms

Flat Assist may modify prospective membership features, service limits, prices, or these Terms as permitted by law. Any change affecting an existing Member will be communicated in the manner and within the notice period required by applicable law.

14. Electronic Communications

The Member agrees to receive enrollment confirmations, receipts, renewal and cancellation notices, service-status messages, and other transactional communications electronically by email and SMS text message.

Message and data rates may apply. Message frequency varies. Members may opt out of text messages at any time by replying STOP, and may reply HELP for assistance. Opting out of text messages does not cancel the membership and does not stop transactional email.

Promotional email or SMS communications are sent only in accordance with applicable consent and opt-out requirements.

15. Mobile Application, Location, and Account Access

Roadside service requests may require the Member to provide or permit access to precise location information so that Flat Assist can locate the vehicle and dispatch service. The Member is responsible for maintaining account credentials and for notifying Flat Assist of suspected unauthorized account use.

Our Privacy Policy describes how personal information, location data, vehicle information, service history, device information, and related data are collected, used, shared, and retained.

16. Authorization to Access and Service the Vehicle

By requesting roadside service, the Member represents that the Member owns the vehicle or has lawful authority to authorize the requested service. The Member authorizes Flat Assist and the assigned technician to perform the requested eligible roadside service and to take reasonable actions necessary to attempt that service.

17. Nature of the Membership

A Flat Assist membership provides direct emergency roadside assistance services. It is not an insurance product, a motor vehicle service contract, or a general reimbursement program. Except for expressly stated membership benefits, Flat Assist does not reimburse Members for third-party expenses.

18. Damage, Risk, and Limitations

Flat Assist uses reasonable care in providing roadside services. To the fullest extent permitted by applicable law, Flat Assist is not liable for indirect, incidental, special, consequential, or punitive damages arising from the membership or the services, including delays, inability to complete a service attempt, pre-existing vehicle conditions, or Member-supplied equipment such as spare tires.

Nothing in these Terms limits any right that cannot be limited under applicable Florida law.

19. Suspension or Termination by Flat Assist

Flat Assist may suspend or terminate a membership for material breach of these Terms, fraud, misuse of services, nonpayment, abusive or unsafe conduct, or other lawful reasons.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida. Disputes will be handled in a court of competent jurisdiction located in Broward County, Florida.

21. Assignment; Severability; Entire Agreement

The Member may not transfer or assign the membership except as expressly permitted by Flat Assist. Flat Assist may assign its rights and obligations as permitted by law. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. These Terms, the applicable plan description, the checkout disclosures, and the incorporated Privacy Policy constitute the agreement regarding the membership.
